Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and DeskSetupCreator. By creating an account or otherwise using the service at desksetupcreator.com (the “Service”), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Your account

You must be at least 13 years old (or 16 in the EEA/UK) to create an account. You're responsible for keeping your credentials safe and for everything that happens under your account. Tell us immediately if you suspect unauthorized access.

3. Acceptable use

You agree not to:

• Upload photos you don't have rights to use.
• Upload content that depicts minors in a sexual or exploitative way, or content that violates the law where you live.
• Use the Service to generate hateful, harassing, deceptive, or sexually explicit content.
• Attempt to extract, reverse-engineer, or interfere with our models, infrastructure, or other users.
• Scrape, mass-download, or otherwise abuse the API or the public gallery.
• Resell credits, accounts, or generated outputs as a standalone product.

We can suspend or close accounts that violate this section. Serious violations are reported to law enforcement when required.

4. Your content

Anything you upload (room photos, prompts, saved setups) is your content. You keep ownership. You grant us a worldwide, non-exclusive, royalty-free license to host, process and display your content solely to operate and provide the Service to you (rendering, displaying in your library, serving over the sharing flow if you opt in).

That license ends when you delete the content or your account, except for backup copies retained for a short period and any copies we're required to retain by law.

5. AI-generated output

Renders and configurations generated by the Service are yours to use, including for commercial purposes, subject to the rules below.

• AI outputs may resemble copyrighted designs, brands or products. We don't guarantee they're free of third-party rights. You're responsible for clearing rights before commercial use (e.g. selling prints, using a render in advertising).
• The Service can occasionally produce inaccurate, misleading or unflattering output. Don't rely on it for safety-critical decisions.
• Don't pass off AI-generated renders as photographs of real rooms or finished installations when doing so could mislead a buyer, employer, or regulator.

6. Product recommendations & affiliate links

We recommend monitors, desks, lighting, and accessories based on what fits your room. Some of those links earn us a commission if you purchase through them. The recommendation is editorial — we never accept payment for placement, and the price you pay is unchanged. We are not the seller; warranty and shipping issues are with the retailer.

7. Payments, credits and refunds

Some features (HD renders, large credit packs, priority queue) are paid. Payments are processed by Stripe. All prices are in USD unless stated otherwise and are exclusive of any taxes that apply where you live.

Credits

Credits represent a prepaid balance you can spend on generations and edits. Credit packs (Creator and Pro) are one-time purchases — no subscription, no auto-renewal — and credits never expire. We may change pricing for future purchases at any time; pricing in your original receipt is honored for that purchase.

Refunds

We'll issue a full refund within 14 days of purchase if no credits from that purchase have been spent. After that, refunds are at our discretion (we're generally happy to make it right — email us). Refunds for accidental duplicate charges are always granted.

Chargebacks

Please contact us before issuing a chargeback. Filing a chargeback without contacting us first may result in account suspension while we investigate.

8. Our intellectual property

The Service, its design, brand, software, and the underlying models we operate are owned by us or our licensors. These Terms grant you no rights in our IP except the limited right to use the Service as intended.

9. Third-party services

The Service is built on Clerk (auth), Convex (database), Stripe (payments), and Google's Gemini models (image generation). When you use those features, the respective provider's terms also apply. We're not responsible for downtime or behavior of third-party services beyond our control, but we'll do what we reasonably can to keep things running.

10. Termination

You can close your account at any time from /dashboard/settings. We can suspend or terminate accounts that violate these Terms, with notice when possible. Unspent credits in a terminated account are forfeited only if the termination is for serious violation; otherwise we'll refund the pro-rated balance.

11. Warranties and disclaimers

The Service is provided “as is” and “as available”. To the maximum extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable for your needs.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100. We're not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction. Nothing in this section limits any consumer protections you have under the law of the country you live in.

15. Changes

We may revise these Terms as the Service or the law evolves. We will update the “Last updated” date and, for material changes, notify you in advance by email or in-app. Continued use of the Service after the effective date means you accept the revised Terms.
